General information

These General Booking Conditions govern the commercial relationship between CHARTDOSMIL26 SL (hereinafter, EasyWave) and the client for private boat trips with skipper.

Making a booking implies the client’s express acceptance of these conditions. They apply in accordance with Spanish Law 7/1998 on General Contracting Conditions, Law 3/2014 (consolidated text of the General Law for the Defence of Consumers and Users), the General Data Protection Regulation (EU) 2016/679 and Law 34/2002 on Information Society Services and Electronic Commerce.

The client declares that they are of legal age and have the legal capacity to enter into a contract. EasyWave reserves the right to modify these conditions; the conditions in force at the time of booking will apply.

How to book

Bookings are made by contacting EasyWave via WhatsApp (+34 655 081 950) or email (info@easywave.es). The booking is confirmed once the corresponding deposit has been received. Availability of dates is subject to demand; we recommend booking as far in advance as possible.

Prices

The prices for each trip are indicated in euros and include applicable taxes. The prices in force will be those published on the website at the time of booking. EasyWave reserves the right to modify offers and prices simply by updating the content of the website.

Fuel is not included in the trip price and is paid at the end of the trip based on actual consumption. Optional packs (drinks, snack or comfort) are ordered when booking and paid together with the remaining balance.

Payment

To confirm the booking, a deposit of 30% of the total amount is paid. The remaining 70% is paid on the day of the trip, before setting sail.

Cancellation by the client

  • More than 7 days before the trip: full refund of the deposit paid.
  • 7 days or less before the trip: the deposit is not refunded.

Date changes

  • More than 7 days in advance: free date change, subject to availability.
  • 7 days or less in advance: date changes are not accepted, except in the case of cancellation due to weather conditions at the skipper’s discretion.

Cancellation due to weather conditions

Safety on board is our priority. If weather conditions do not allow safe navigation, the decision to cancel rests with the skipper, who will assess it with professional judgement. In that case, the client may choose between:

  • A date change at no additional cost, subject to availability.
  • A full refund of the amount paid.

Right of withdrawal

In accordance with article 103 of Spanish Law 3/2014, leisure activity services provided on a specific date are exempt from the right of withdrawal. Therefore, once a specific date has been booked, the cancellation conditions described above apply.

Complaints

If the client wishes to file a complaint, they may do so by email at info@easywave.es. EasyWave has official complaint forms available to consumers and users.

In accordance with Regulation (EU) 524/2013, the European Commission provides an online dispute resolution platform available at: https://ec.europa.eu/consumers/odr

Applicable law and jurisdiction

The relationship between the client and EasyWave is governed by the regulations in force and applicable in Spanish territory. Should any dispute arise, the parties may submit their conflicts to arbitration or resort to the ordinary courts.
